1. Service Scope

• YachtClear is an online document submission and forwarding platform for yacht clearance.

• Our role is limited to:

  • Collecting clearance documents from captains/agents.

  • Organizing and forwarding them to designated local agents or authorities.

• We do not provide clearance approvals ourselves. Clearance is always subject to the respective port authority and local agent decisions.

2. No Guarantee of Clearance

• YachtClear does not guarantee:

  • Approval or acceptance of documents by port authorities.

  • Speed of clearance.

  • Any specific outcome of clearance.

• Final clearance is outside our control and depends on local regulations, port policies, and government rules.

3. Third-Party Fees

• The €30 document-processing fee is charged by YachtClear for organizing and forwarding documents only.

• All local agent, port, and government fees are separate and must be settled by the captain/agent directly.

• YachtClear is not liable for third-party charges.

4. Limitation of Liability

• YachtClear shall not be held responsible for:

  • Delays, rejections, or penalties imposed by ports or government authorities.

  • Losses, damages, or additional costs arising due to clearance delays.

  • Incorrect or incomplete information/documents provided by the captain/agent.

• The service is provided on an “as-is” basis, and users are responsible for verifying local clearance requirements.

5. Jurisdiction

• This Disclaimer is governed by the laws of India.

• Any disputes shall fall under the jurisdiction of the courts in Surat, Gujarat, India.
